HFHR as an official observer in the case of Professor Jan Miodek

The first hearing in the action brought by Professor Jan Miodek against Editor Grzegorz Braun regarding the protection of personal property will begin on 4 October 2007 at 9.00 a.m. before the Regional Court in Wroclaw.

 

The case concerns a statement by Editor Braun, which was made on air at Polish Radio Wroclaw on 20 April 2007, and in which the journalist accused Professor Miodek of collaborating with the secret service, at the same time calling into question his legitimacy to express opinions against the lustration of university employees.

Professor Jan Miodek has issued a public statement, in which he denied having collaborated with security agencies of the PRL at any time, and moreover indicated all situations, in which he came in contact with these agencies.

 

A Historical Committee was appointed in this case at the University of Wroclaw, which began to examine the records concerning Jan Miodek found at the Institute of National Remembrance (IPN). In the announcement of 17 May 2007, the Committee described the documents made available by the IPN and stated that these are merely internal documents created without the interested party's knowledge and that the assembled material does not allow drawing unequivocal conclusions. The Commission had to cease its work as a result of the Constitutional Tribunal verdict of 11 May 2007, which lifted the regulations allowing scholars to have access to IPN records.

 

In the suit filed at the end of May, Professor Miodek demands that the defendant issues a public apology and makes a public donation in the amount 50 thousand zloty. Grzegorz Braun petitions for the court to dismiss the suit in its entirety.
