Program description

Students from Warsaw University's Faculty of Law and Administration and the Institute of Social Prevention and Re-socialisation, as well as the Law Faculty of the Ryszard Łazarski University of Commerce and Law take part in the "Clinic 42" program.

 

Article 42 of the Polish Criminal Executive Code allows a convicted offender to appoint a person of public trust as his representative. The students taking part in the Clinic, upon prior authorization by the convicted person, can act as such representatives. In such case, they act exclusively in the interest of the convicted offender placed in a penitentiary unit, as well as one remaining at liberty or placed under pre-trial detention. To this end, they file motions, complaints and requests on his behalf to appropriate organs and institutions. With the Court's permission, they can also represent the convicted offender during proceedings before the Penitentiary Court.

 

The Program deals with cases regarding:

 

  • conditional release from serving the full sentence,
  • break from serving the sentence of imprisonment,
  • chance permits to leave the prison,
  • inadequate health care at prison facilities,
  • inadequate treatment by Prison Service officers.

 

Professor Andrzej Rzepliński is the program's guardian responsible for the contents.

During the classes students discuss their cases and suggest actions that should be taken in the specific case. Each decision must be approved by a lawyer. Prof. Andrzej Rzepiński makes the decision to back a motion for conditional release from serving the full sentence or a break from serving the sentence before the Penitentiary Court.

People who professionally handle cases of convicted offenders are also invited to the Clinic's meetings - they include: representatives of the Central Management of the Prison Service, attorneys, as well as individuals who were placed in remand centers or penitentiary units. These meetings are aimed at describing the actual functioning of Penitentiary Units.
